Public Enterprises Minister Pravin Gordhan’s defamation and crimen injuria charges against the EFF are an attempt to silence the party, EFF president Julius Malema and his deputy Floyd Shivambu, said.
“This application is nothing other than a thinly veiled attempt by Mr Gordhan to silence me and the deputy president of the EFF, Mr Floyd Shivambu. By extension, Mr Gordhan seeks to silence the EFF,” Malema said in an affidavit.
In November 2018, Malema spoke outside the Zondo commission of inquiry into state capture, where he referred to Gordhan as a “dog of white monopoly capital (WMC)” and requested EFF members and supporters to be “ready for war”.
He also took aim at Gordhan’s daughter Anisha, claiming the National Treasury and other government departments awarded contracts to her as a result of her father’s position in the government.
In addition, Malema’s deputy accused the minister and his daughter of being corrupt.
‘Promote hatred’
But Gordhan did not take the comments lightly and approached the courts for relief.
In a statement released when he laid a complaint with the Equality Court, Gordhan claimed the comments by both EFF leaders constituted contraventions of Section 10 of the Equality Act, explaining that they were intended to be “hurtful, incite harm and to promote hatred”.
The minister is seeking an unconditional apology from the two and damages amounting to R150 000.
But the two have accused the minister of attempting to limit their freedom of speech and freedom of association, and of creating an environment of intimidation in which he is not allowed to be questioned or criticised in public.
They also accused the minister of using the courts to settle political battles.
Malema further argued that Gordhan’s civil complaint could lead to the EFF being severely prejudiced in its ability to criticise the minister and that if he and his deputy were found liable, so too would their political party.
He insisted that Gordhan failed to understand the political nature of his speech and even cited 2015 a Constitutional Court ruling in favour of the DA.
That court found that the DA was within its rights when it said in an SMS that former president Jacob Zuma had stolen money for security upgrades at his private home in Nkandla.
Malema said even a “weak factual link” used to sustain an accusation could qualify as “non-defamatory” speech.
The two claimed that they based some of their comments on numerous reports which have never been taken on review. Among them are:
In Shivambu’s affidavit, he said: “He is a political bully unable to accept political punches.”
He also raised concerns about a perceived failure to critically assess Gordhan.
“The media has completely failed to seriously engage Mr Gordhan regarding his complicity in the Zuma state capture project,” he argued.
Shivambu said the media was already predisposed to rejecting anything the EFF had to say, in favour of the minister.
The matter was before the Johannesburg Magistrate’s Court on Monday, where it was postponed after the parties agreed to take the matter to a higher court.
An overactive bladder is a common urinary condition which causes a sudden urge to urinate. It may be difficult to control the urge, and this may lead to involuntary urination, called urge incontinence.
Urge incontinence may occur in anyone at any age, but is more common in women and the elderly.
Although incontinence is not detrimental to the physical well-being of the patient, it can have far-reaching effects on their social, sexual, recreational and working lives and cause a dip in self-confidence and body-image. It is therefore important that urge incontinence be managed.
An implant may be the answer
New technology may offer a form of treatment. A new report by researchers, published online in the journal Nature, focuses on a soft, wireless implant that can help control the frequent urge to urinate.
This implant makes use of optogenetics, a method to control cells with light. The implant regulates the nerve cells which stop the bladder from overfilling by means of tiny light-emitting valves. The research was conducted on rats with medically induced overactive bladders.
Although optogenetics has previously been implemented to manipulate brain cells, research is increasingly focusing on investigating how it can be used to manipulate cells throughout the entire body.
More targeted than previous treatment
According to Bozhi Tian, a materials scientist at the University of Chicago, there is currently a treatment that uses electric currents to regulate the nerve cells in the bladder. However, this is not ideal, as the electric currents target a wide area of nerve cells and affect surrounding organs as well.
The new implant focuses on one specific area and does not affect surrounding nerves. It also only targets the specific area when necessary, according to Science News. The programme detects the urinary urge of the user, indicating to the implant when to turn on the tiny light frequencies. This then zaps the cells, preventing them from sending those messages to the brain.
This study is described as effective for short-term use, but more research is needed to see how the body responds to the implant over a longer period of time.
Other ways to manage an overactive bladder
While the implant is undergoing research and is not yet ready to be implemented, there are other methods to manage an overactive bladder you can use right now. These include:
Pelvic floor exercises
Bladder training
A treatment called “biofeedback”, where electrodes are placed on the abdomen and anal areas

Cape Town – South Africa are looking to make it three wins in a row when they take on Sri Lanka in the third and final women’s T20 international at SuperSport Park tomorrow.
They won the second match by a narrow, two wickets with one ball to spare to clinch the series but all-rounder Marizanne Kapp is looking for a much improved performance from the team, in particular the batting unit.
“We’ve not played our best cricket at all,” she said during her pre-match media briefing at SuperSport Park this afternoon.
“I think we were a bit lucky coming out on top there but having said that, we’re missing players like Lizelle Lee and Chloe Tryon which leaves quite a big hole in your batting line-up. It was good to see the youngsters take us over the line, but we need to do better if we want to win tomorrow. I was up there at number three, I should have ended the game there. But if we come out on top playing the way we did, I’ll take it any day.”
Kapp admitted that the team still had some distance to go before they get to where they want to see themselves in world cricket and with the introduction of their crop of youngsters, the coaches have a few more combinations to consider as they begin to plot their way towards the 2020 ICC Women’s T20 World Cup. She believes that having young players with nerves of steel will serve the team in good stead in the future.
“There’s still a lot of work to be done,” she continued.
“We’re still trying out a few new combinations and we have a few new faces in our squad as well, so we’re still working things out and hopefully we can just get better as we get along. It’s good to see such fearlessness from the younger players, to still come out on top and have them in at the end there to take us over the line, that’s a big learning curve for them and we’ll take that any day. Hopefully tomorrow’s match will be a bit more clinical.”
The team has seen a few changes since their disappointing turnout in the 2018 World T20. Kapp is pleased with the heightened sense of competition in the squad and believes that the measures that Cricket South Africa have put in place says a lot about the organization’s commitment to supporting the national women’s team in their ambition to become world beaters.
“It’s good signs for us because it shows how seriously CSA is about taking women’s cricket forward. We can’t settle for second best. We’re at that stage now where if we don’t make our fitness and if we don’t score runs or play our part, we’re gonna have to bring in youngsters and I think that just shows where we’re at as a team and where we want to see ourselves in the months and years to come,” she concluded.
The women’s T20i will start at 13:00 and will be live on SuperSport 2.
