Pretoria, 01 October 2018 – Individual taxpayers have 30 days left to file their personal income tax returns.
Tax Season closes on 31 October for non-provisional taxpayers and for those provisional taxpayers who opt to file at a branch. Provisional taxpayers ordinarily have until 31 January 2019 to file on eFiling only.
The focus this filing season has been on the 24-hour eFiling channel which taxpayers can use at their leisure without having to go to a branch. eFilers are supported by the Help-You-eFile mechanism during business hours, which links them to a SARS contact centre agent who can assist the taxpayer to complete their tax return.
In the last month of filing season, the SARS contact centre will be available on Saturdays on 06 – 27 October from 8 am to 1 pm, to support taxpayers with eFiling.
All SARS branches will also be open on Saturdays at the same time where taxpayers can make use of self-help kiosks to electronically file their personal income tax returns.
It is important to note that the extended hours on Saturdays will only be used to assist with personal income tax returns.
To date, SARS is close to reaching the 3-million mark in tax return submissions for the current year of assessment. This is approximately a 4% increase compared to the same time last year. Of these returns, 51% have been submitted through eFiling.
Administrative penalties will be applied to late filing of tax returns and range from R200 to R5000. In accordance with the Tax Administration Act No. 28 of 2011 (TAA), and specifically Section 234 (d), it is a criminal offence not to submit a tax return for any of the tax types a taxpayer is registered for.
SARS has clamped down on outstanding tax returns to improve compliance, with 18 taxpayers prosecuted this year for not filing a return. These taxpayers, who were publicly named, had ignored SARS’ reminders that they were due to file a return, and now possess a criminal record. Fines ranging from R2000 to R20 000, as well as admission of guilt fines were handed down by the courts, while some were imprisoned.
Taxpayers should be alert of scams where refunds are promised or where the taxpayer is informed of debt they owe SARS. These scams come in various forms including letters, email, website links and even individuals either posing as SARS officials, debt collectors or tax preparers. There are instances where tax preparers promise taxpayers a refund in return for a percentage of the refund as a fee. Fraud is often committed in the name of the taxpayer by claiming fraudulent expenses. When SARS does identify this fraud the taxpayer will be liable for the full debt as well as penalties.
Taxpayers should always authenticate communication in relation to SARS via the contact centre or a SARS branch. Suspicious tax activity can reported online or via the SARS suspicious activity hotline.
Taxpayers are reminded that tax season is about reconciling tax deductions from the previous year and assessing whether the correct amount of tax was deducted. This assessment can result in a refund to the taxpayer or a payment to SARS where the taxpayer owes tax to SARS. Alternatively it can result in a nil return, where the taxpayer neither owes SARS nor is due a refund.

The Verulam Family Court is expected to make a ruling on Tuesday on whether Kessie Nair can apply for bail or be sent for mental observation before applying for bail.
State prosecutor Carlson Govender and Nair’s attorney Chris Gounden submitted their final arguments on Monday afternoon on the state’s application that Nair be sent for a 28-day mental assessment at Fort Napier Hospital in Pietermaritzburg.
Nair – the former Durban councillor and convicted fraudster who called President Cyril Ramaphosa the k-word in a widely circulated Facebook video – has been charged with six counts of crimen injuria and two of incitement of public violence.
Govender argued that Nair should be treated as an in-patient at Fort Napier.
He said the court should consider the evidence of a district surgeon who examined Nair on the day of his first court appearance, the evidence of Nair’s brother Krishnan and that of the investigating officer Warrant Officer Ajay Lutchnan.
Signs of mental illness
The district surgeon had found that Nair showed no signs of mental illness but recommended that he should be sent to Fort Napier for 28 days, the court heard.
Krishnan told the court that he noticed “changes” in Nair’s mental state when he visited him at Westville prison on “numerous occasions”.
Lutchnan told the court that there was a time when he couldn’t understand what Nair was saying when he took his fingerprints on the day of his arrest.
Lutchnan said they had interacted about Nair’s time in prison and about Nair “belonging to a 26 section of the prison”.
However, Gounden hit back at the state’s witnesses.
“The district surgeon is incompetent to do a mental observation, has no qualifications to deal with someone’s mind and lacked expertise to make such an assessment. The district surgeon recommended that the accused be sent to Fort Napier but found that he had no signs of mental illness, which is contradictory,” argued Gounden.
His said Krishnan’s evidence should not be considered because “he can’t manage his own affairs” and had also “sought assistance”.
Krishnan had admitted in court that he was a member of Alcoholics Anonymous but said he had been clean for two and a half years.
Gounden also argued that Nair should have been summoned to appear in court instead of being arrested. He said most people who were facing crimen injuria cases had only been summoned to appear in court.
High-profile case
Gounden also argued that Nair’s case was not a high-profile case.
“Whether it’s the president or domestic worker, every man is equal before the law. There’s also nobody toy-toying outside the court except for a few reporters in court,” he said.
He also submitted that Nair was on a donor list for a heart.
“The state has failed to bring to your attention that there’s a waiting list for beds at Fort Napier. The first available date is some time in April next year,” he said.
Gounden said Nair should be granted bail as he would avail himself should he be needed in court.
The court heard that other complainants in the matter were eThekwini Mayor Zandile Gumede, her deputy Fawzia Peer, KZN Human Settlements and Public Works MEC Ravi Pillay, former deputy mayor and speaker of the eThekwini municipality Logie Naidoo and former eThekwini councillor Brandon Pillay.
It is not clear whether Ramaphosa and the other complainants in the matter have filed their statements.
The court refused Gounden permission to ask Lutchnan whether Ramaphosa had filed his statement on the matter, since he was listed as a complainant.
Lutchnan, who is attached to the Hawks, told the court that investigations were at an advanced stage in the matter.
He said there were about 10 outstanding statements in the matter.
When News24 asked the NPA whether the president had filed his statement, director of public prosecutions (DPP) in KwaZulu-Natal Advocate Moipone Noko said: “This matter is still under police investigations therefore the details cannot be divulged.”
Magistrate Ncumisa Gcolotela rolled the matter over to Tuesday where she was expected to make a ruling in the state’s application.
Can violent video games push some kids to act violently in real life? A new research review suggests the answer is “yes.”
The analysis combined the results of 24 past studies, involving more than 17 000 children and teenagers. Overall, researchers found, kids who played video games featuring fighting, attacks and killing were somewhat more likely than their peers to become more aggressive over time.
The controversial findings are the latest entry into a long-standing debate over the real-world impact of video game violence.
Over the years, some studies have found a connection between the games and kids’ aggression, while others have not.
The authors of the new review said their results show a “reliable” link. They also said they were able to address the main criticisms that have been leveled at such research in the past.
“My characterisation would be that the effects [of violent video games] were relatively small, but reliable – and not inconsequential in their implications for aggressive behavior,” said researcher Jay Hull, a professor of psychological and brain sciences at Dartmouth College in Hanover, New Hampshire.
According to Hull’s team, most researchers in the field believe there is a connection between video game violence and kids’ aggression.
But, the study authors added, a “vocal minority” has cited flaws in the research. For example, some studies have asked kids about “non-serious” issues like irritability, rather than strictly measuring overt aggression. Still others have failed to account for other factors in kids’ lives that could feed aggressive behavior.
So the Dartmouth researchers said they analysed studies that measured actual physical aggression.
Overall, they found, there was an association between exposure to game violence and increases in kids’ aggressive behaviour – based on reports from kids themselves, or from parents or teachers.
And the connection was not diminished even when studies did account for other factors in kids’ lives, the researchers said.
The findings were published October 1 in the Proceedings of the National Academy of Sciences.
According to Hull, video game mayhem might feed some kids’ aggression because it “rewards” violence and hostile thoughts, while reducing empathy toward victims.
Hull had this advice for parents: “Encourage [your kids] to pursue other, more productive spare-time activities.”
‘Itty-bitty effect’
Not everyone was convinced by the study, however.
Patrick Markey, a professor of psychology at Villanova University in Pennsylvania, has studied the potential link between video games and real-life violence.
He said the new findings point to, at most, a minor influence of video games.
“This suggests that less than 1% of the variance in aggression [among kids] is explained by exposure to video game violence,” Markey said. “That’s an itty-bitty effect.”
Markey also disputed the claim that most researchers agree that video game violence begets real-world violence. He pointed to a 2017 survey of psychology and media researchers that found only 15% believed the games contribute to serious physical aggression in kids.
“The research, to me, is clear that video games don’t cause serious acts of violence,” Markey said.
Even so, he added, parents might have other reasons they want to limit their kids’ exposure to violent games. They might want to “shield them from scary things,” for example, and that’s their call.
Christopher Ferguson is a psychology professor at Stetson University in DeLand, Fla. He led several of the studies included in the new analysis – studies that found no evidence implicating violent video games.
He, too, stressed the small effect seen in this analysis.
As a predictor of kids’ violent behavior, Ferguson said, exposure to video games “was almost no better than a coin toss.”
“I think this is actually evidence against any real effect,” he said.
At this point, Ferguson said, many parents probably already have an opinion on whether they want their kids playing violent video games. And this study is unlikely to change their minds, he said.
“Every parent knows their kid best,” Ferguson said. “They have to use their best judgment.
