eNCA | Herbex stands by testimonials despite ad ban
JOHANNESBURG – Slimming product producer Herbex says it stands by its testimonial advertising, despite the Advertising Standard Authority (ASA) of South Africa having found its ads misleading.
According to the ruling on the ASA’s website, Herbex told the authority it is “not a member of the ASA, will not submit to ASA’s jurisdiction and will not respond to the merits in the complaint”.
A consumer had complained that advertising by Herbex is misleading since “there is no objective evidence that the advertised product has any significant effect on weight loss, and even if such evidence existed, the testimonial is not representative for the majority of users of the advertised product”.
The ASA ruled on the matter purely for the guidance of its members since Herbex refused to submit any evidence.
It found that “the efficacy claims in the commercial are unsubstantiated”.
Members of the ASA were instructed not to accept Herbex advertisements for publication.
In a statement, Herbex subsequently said it stood by its testimonials.
Eddie Bisset, managing director of Herbex holding company Newgroup Holdings, said the company’s many testimonials were “real and factual and supported by an affidavit signed by the featured customers”.
“The ASA has not been mandated by the former Medicines Control Council – now the South African Health Products Regulatory Authority (SAHPRA) – to assess the efficacy or safety of complementary medicines.
“Our products are carefully researched and formulated by industry professionals before going to market, and all manufacturers are GMP [Good Manufacturing Practice] compliant and properly certificated,” Bisset said.
Herbex had submitted product information to the SAHPRA for registration as per a 2015 request, he said.

News24.com | Solomon Mahlangu: A lasting reminder of the sacrifice for freedom
Retracing the last steps struggle icon Solomon Mahlangu took 39 years ago before he was executed, Deputy President David Mabuza said he was reminded that the country could never go back to an inhumane and barbaric past.
Mabuza visited the prison on Friday to mark the 39th anniversary of Mahlangu’s execution and to pay tribute to him.
He said that walking through the gallows of the Pretoria Central Prison was about remembering the life and times of Mahlangu and all other prisoners who had been executed for political reasons.

“Being here is a testament that our struggles were not in vain. Here we are standing outside this cruel place, all of us free. That means, what they [fought] for was real and we are all inspired by their actions of courage,” Mabuza said.
“People had to sacrifice their lives for you and me to be free and this will serve to propel all of us forward to do what is necessary to make this country a better place.”
Mahlangu’s brother Chief Lucas Mahlangu, who accompanied Mabuza, asked South Africans to unite so that everyone could live in peace and harmony.
‘Tell my people that I love them’
“Solly’s blood unite[d] our country even more so that we can march out of this house of bondage in peace,” said Mahlangu’s brother.
“We have been too long in this house [of] bondage. So, by uniting, we South Africans, we will be helping the government grease the hinges of the doors of the house of bondage so that everyone can march out and live in peace and harmony.”
Mahlangu, an Umkhonto weSizwe soldier at the time, was arrested in 1977 shortly after he returned to South Africa from Angola and Mozambique, where he had received training to help with student protests in a continuation of the 1976 uprising.
He was tried and convicted of two murders and three charges under the Terrorism Act.
His last words before he was hanged on April 6, 1979 were: “My blood will nourish the tree that will bear the fruits of freedom. Tell my people that I love them. They must continue the fight.”
His execution provoked international outrage and protests against South Africa’s apartheid policy.

Earlier, a case in which he is accused of contravening the Riotous Assemblies Act by urging his supporters to invade land was postponed in the Mangaung Regional Court in Free State.
In June 2016 he told supporters to occupy land because it was taken from black people by force.
Earlier in the week, Malema failed to appear in the Newcastle Magistrate’s Court on similar charges. He was represented by his legal team and that case was postponed again.
The EFF has been alleged to have been behind a number of land grabs in the recent weeks, with community members saying their local EFF leaders had told them to seize unoccupied land.
The ANC adopted a resolution last year that land should be appropriated without compensation, sparking a land-reform debate nationally.
The public will be able to weigh in on the parliamentary review of section 25 of the Constitution, dealing with land, between May and June and give their input on the government’s plan to expropriate land without compensation.
In a statement, Parliament said its joint constitutional review committee would this month publish an advertisement for oral and written submissions.
