JOHANNESBURG – Well-known businessman and socialite Kenny Kunene said he has been shot at in an apparent attempted hit in Johannesburg.
Kunene has told eNCA that he was travelling on Corlett Drive when a white vehicle pulled up in front of him and the occupants began shooting at his car.
He was travelling with a passenger. Both of them were shaken but unhurt. Kunene said he would open a case at the Bramley police station.
Kunene has been outspoken about his support for Sunday Independent editor Steven Motale.
Deputy President Cyril Ramaphosa attempted a court interdict to stop the newspaper publishing stories on his private life. Motale said he had received death threats.
Kunene has also published stories about the so-called Ramaphosa email leaks on his website called the Weekly Xposé.

News24.com | Julius Malema to attend Sindiso Magaqa funeral under certain conditions
Durban – EFF leader Julius Malema on Tuesday said he would attend the funeral of former ANC Youth League (ANCYL) secretary-general Sindiso Magaqa on condition that a “thorough security assessment” is done beforehand to ensure that his life is not taken by “bloodthirsty murderers”.
In a statement, Malema said he recently missed a funeral because of threats made on his life.
“We never fear death, but no one takes our life. As revolutionaries, we give our lives to the struggle, and if needs be, we shall pay with our lives, but not under the conditions chosen by hostile forces.”
Malema said he wanted to attend the funeral to pay his respects and find peace after the trauma he had suffered following the news of Magaqa’s death.

Malema said he was on his way back from a meeting when he received news of Magaqa’s passing.
“The phone call carrying this sad news was brief and to the point, yet it froze my entire body in shock to the point of inevitable and unending tears,” Malema said.
“I could not withhold my tears, which uncontrollably kept showering my face. The last time a shadow of death overcame my heart in such a manner it was on the occasion of the passing of my mother.”
Malema said he was “shocked” to receive an invitation from the KwaZulu-Natal ANCYL to Magaqa’a funeral.
“I do not know of anywhere in our traditions where people get invited to funerals.”
Date for funeral not yet set
ANCYL secretary-general Njabulo Nzuza told News24 that no invitations to the funeral were issued.
“People who seek to attend funerals never attend on an invite,” Nzuza said. He said Malema’s claim that he had received an invitation was a publicity stunt.
Nzuza said a date for Magaqa’s funeral hadn’t been set yet.
Magaqa, a ward councillor in Umzimkhulu in southern KwaZulu-Natal, died at the Albert Luthuli Hospital in Durban on Monday from gunshot wounds he sustained in a suspected ambush in July. He was 35 years old.
Magaqa and two other Umzimkhulu ANC councillors were shot on July 13 while on their way back from an ANC meeting, KwaZulu-Natal community safety MEC Mxolisi Kaunda said in July.
“As the victims arrived at the bus stop, they were attacked by unknown assailants who were armed with rifles. They sustained serious injuries after the suspects unleashed a hail of bullets at their car,” Kaunda said.
Kaunda said two councillors and a former councillor from the same municipality had been shot dead within four months.
In April, Harry Gwala ANC region deputy secretary and Umzimkhulu municipality speaker Khaya Thobela was shot dead. In May, former Umzimkhulu councillor and branch leader Khaya Mgcwaba was gunned down.
Later that month, Mduduzi Tshibase‚ a teacher and Umzimkhulu councillor, was killed at his home in Umzimkhulu.
Political analysts who testified at the Moerane Commission into political killings in KwaZulu-Natal said most killings were related to competition over political positions. In October last year, KwaZulu-Natal Premier Willies Mchunu announced that he was setting up the Moerane Commission following a spate of political killings in the province.

Johannesburg – After more than seven hours of arguments the Constitutional Court has reserved judgment in an application brought by the EFF and other opposition parties trying to have President Jacob Zuma impeached.
The opposition parties told the court that they wanted the establishment of a fact-finding ad hoc committee that would force Zuma to answer questions about his conduct during the Nkandla debacle.
The parties, which also included the UDM and Cope, strongly felt that no action had been taken against Zuma after the Constitutional Court ruling in March 2016 which found that Zuma had failed to uphold, defend and respect the Constitution.

They said there was no doubt that there was prima facie evidence for impeachment proceedings to be instituted against Zuma.
However, Hamilton Maenetje, representing National Assembly Speaker Baleka Mbete, said the Speaker’s office would be acting inconsistently were it to remove Zuma.
“Because the Speaker plays the role of a referee, it would be inconsistent with her office to initiate the removal of Zuma,” Maenetje told the full bench of justices.
Removing Zuma would be ‘inconsistent’
Maenetje was arguing against an application brought by the EFF, the UDM and Cope against Mbete and Zuma for various orders directed against them.
The orders include one declaring that Mbete failed to put in place all appropriate procedures and mechanisms to hold Zuma accountable following the president’s failure to implement recommendations in the former Public Protector’s report into Nkandla in 2014.
Maenetje admitted to the court that he personally accepted that Zuma had violated the Constitution.
“As a lawyer, the conduct is a serious violation,” he said.
“Our submission is that judgment rests with National Assembly. [It] would be inconsistent with separation of powers.”
He asked the court not to declare failure to fulfil constitutional obligation on Mbete’s part.
When asked why Mbete had not taken the initiative to establish an ad hoc committee to investigate Zuma’s conduct, Maenetje said: “The Speaker doesn’t set up ad hoc committees, it’s the responsibility of National Assembly. She doesn’t have powers to.”
Maenetje added that the fact that the president had not been impeached didn’t mean that the Speaker had failed to take action.
The justices grilled Maenetje, saying that holding executives accountable rested on all the members of the National Assembly, including the Speaker.
Inquiry an opportunity for Zuma
Advocate Dali Mpofu, representing the UDM and Cope, said he believed that a fact-finding inquiry would force Zuma to account for his actions.
Mpofu said the 27 question and answer sessions conducted by the National Assembly had been insufficient. He said an inquiry would allow interrogators to probe further and request evidence to prove the truth of what Zuma had said in his statements.
He said question and answer sittings differed from inquiry hearings.
“In an inquiry nobody is going to ask you to sit down or raise a point of order,” he said.
Mpofu said the inquiry would be an opportunity for Zuma to answer questions.

“Nobody is going to tell you that that question had been answered. Nobody is going to switch off the mic. We are coming to the court to say the correct process is that there must be an inquiry,” he said.
Mpofu said it should be determined whether Zuma violated the Constitution knowingly or if he was given bad advice.
“We are not vindicating his (Zuma) rights, we are vindicating the rights of the people,” he said.
Responsibility lies with the Speaker
However, Deputy Chief Justice Raymond Zondo said there had been poor communication between the parties.
“Does this not tell us that there is a problem? These parties are not talking to one another?” Zondo asked. He wondered why opposition parties were turning to the courts for answers when solutions were available in the National Assembly.
He said if parties in Parliament communicated better, issues would be resolved with more success in the House.
Earlier, Chief Justice Mogoeng Mogoeng asked the EFF if it was asking to “kill” Zuma’s term in office.
“You are asking to kill the president’s term of office, have him removed?” Mogoeng quizzed EFF lawyer Advocate Tembeka Ngcukaitobi. “In order to kill whatever it is you want to kill, you can shoot or use tradition…or knife. Your client wants to kill the president’s term of office.”
Mogoeng repeatedly asked all the lawyers representing the opposition parties whether they doubted the Nkandla judgment which found that Zuma’s conduct amounted to a serious violation of the Constitution.
“We have no doubt,” Ngcukaitobi replied.
However, Mpofu said there had been doubt, adding that the doubt was sowed by the Nkandla judgment and the former Public Protector’s report.
But Ngcukaitobi argued that it couldn’t be said that an investigation into Zuma’s conduct had been conducted.
“The primary responsibility to hold someone accountable lies with the Speaker…There is no dispute that there is a prima facie impeachable case against the president,” he said.

Proudfoot admitted that he feels Mtawarira is playing his best rugby since the 2009 British and Irish Lions series when he made a name for himself by manhandling experienced England tighthead prop Phil Vickery.
“He’s the guy with 92 Test caps and you have to respect that and it’s a pleasure to work with the most capped South African prop‚” Proudfoot told TimesLive.
“He’s eager to learn and he’s getting back to carrying the ball more and passing the ball more.
“His defence has also been exceptional.
“When a guy gets that‚ they become confident and that’s probably what’s evident in the squad at the moment.
“Coach Allister Coetzee did say at the start of the year that we wanted improvement and everybody has gone on their shoulder and improved everything.
“Mtawarira’s rewarded us and that’s created the appetite in the team and that’s evident in everything. Beast wants to play for another couple of years and he has to be ambitious to do that.
“That’s been the growth in him.

JOHANNESBURG – The African National Congress (ANC) says it doesn’t have the authority to investigate Deputy President Cyril Ramaphosa’s claim that state intelligence services are conspiring against him.
ANC secretary general, Gwede Mantashe briefed journalists on Tuesday on preparations for the party’s December elective conference.

Mantashe also reacted to the ongoing political killings in KwaZulu-Natal.
Even though its members are killing each other in KwaZulu-Natal (KZN), and its Deputy President says state intelligence services are being used against him in his bid to become party president, the ANC is adamant all is on course for its upcoming elective conference.

The party says nominations for the next crop of leaders will soon start at branch general meetings under the supervision of regional executive committees.
And while there’s an acceptance that the ANC is doomed if intelligence services are being used to neutralise political opponents – much in the same way it was in the run up to the Polokwane elective conference – the party has no plan to try and prevent this.
“The ANC has no direct authority over state institutions. When they listen to your conversations over the telephone, all we can say: ‘Hey this thing of being listened to is bad.’ And tell our comrades that run the state security ‘Please, lets not be listened to when we phone.’ That’s why you can’t ask what the ANC will do with state institutions,” said Mantashe.
Mantashe says the use of state institutions to fight political battles dates back to the days of the apartheid government.He urged those raising their hands for the party’s top jobs not to resort to dirty tricks.
The governing party doesn’t have a direct plan to combat the political killings that have escalated in KZN.
“We were in KZN even two weeks ago and we are going there on Monday. We are doing political work. Assassinations are political activities, but they are criminal. Therefore institutions of the state must do their work in ensuring anybody assassinating another will be arrested. Whether or not it’s political will emerge,” said Mantashe.
The ANC is under mounting pressure as its crucial December elective conference approaches.
Mantashe warned ill-disciplined members that tough action will be taken against them.

As pointed out by AfricaCheck (on Twitter at the time, and in a subsequent article today), and other Twitter users, this statement is definitely incorrect.
While “Heart disease is not THE leading cause of death in SA, four times more than murder” is most definitely incorrect, it would have been better to say “Heart disease is A leading cause of death in SA, four times more than murder”.
Even then, that would have been based on 2015 statistics, and no longer relevant.
The tweet mentioned above was deleted, as indicated, but not related to the matter above.
While we acknowledge that the statement was incorrect, and we should not have tweeted it, the tweet was also curated incorrectly – the headline and associated link were not related.
Once we discovered that we deleted immediately.
