Pretoria, Thursday 26 March 2020 – On 23 March 2020, the North Gauteng High Court handed down judgment in favour of the Commissioner in the matter between the Commissioner of SARS v The Public Protector and three others under case number 84074/19, which confirms that taxpayer information is confidential.
The Public Protector who, in the course of conducting an investigation, is empowered to subpoena any person for information in terms of section 11(3) of the Public Protector Act, 1994 had subpoenaed the Commissioner to provide taxpayer information in relation to such an investigation.
In terms of the Public Protector Act, 1994, a person is compelled to comply with a subpoena issued by the Public Protector unless there is “just cause” not to comply. The Commissioner therefore sought a declaratory order from the Court to clarify whether the Commissioner had “just cause” to decline to provide the Public Protector with taxpayer information because the Tax Administration Act, 2011 (TAA) does not allow disclosure.
The TAA prohibits SARS from releasing taxpayer information unless the disclosure falls within an exception to the general rule that safeguards taxpayer information expressly provided for in the TAA. The TAA, however, does not authorise SARS to release taxpayer information to the Public Protector, as an exception. In fact, releasing such information would be a breach of the confidentiality provisions, which is a criminal offence in terms of the TAA.
The Court ruled that:
“1. It is hereby declared that a South African Revenue Service Official is permitted and is required under the provisions of “just cause” contained in section 11(3) of the Public Protector Act … read with section 61(1) of the Tax Administration Act … to withhold taxpayer information as defined in section 67(1)(a) of the Tax Administration Act…
2. … the Public Protector’s subpoena powers do not extend to the taxpayer information”
Commissioner Kieswetter welcomes the judgement as it confirms that the Public Protector’s powers derived from the Public Protector Act do not claim superiority over the confidential status of taxpayer information prescribed in the TAA. He also points out that whilst this case may attract attention because it involves a prominent person, the underlying principle of confidentiality applies to every taxpayer equally and the entire tax base stands to benefit from this authoritative pronouncement.
Although the judgment relates to the Public Protector’s subpoena powers, most importantly, it confirms a number of fundamental principles of the confidentiality of taxpayer information says Commissioner Kieswetter.
First: Taxpayer information is sacrosanct. Since his appointment at SARS, Commissioner Kieswetter has continuously reiterated that SARS’ guarantee of confidentiality is what the taxpayer gets in return for the compulsion to provide open and full information to SARS. Without the statutory guarantee of confidentiality, the expectation that the taxpayer will be candid and accurate with SARS diminishes. It is the very foundation of the tax system in South Africa and generally tax systems worldwide, without which any tax administration cannot properly function
Secondly, every SARS official is legally required to treat taxpayer information with the utmost confidentiality and not to disclose it. Releasing such information would be a breach of the confidentiality provisions, which is a criminal offence in terms of the TAA. Every SARS official takes an oath or makes a solemn declaration to comply with the statutory confidentiality provisions. SARS officials adhere to their oath stringently and must continue to do so obsessively if we expect taxpayers to trust SARS. Commissioner Kieswetter has committed SARS to continuously strengthening its information security culture, systems, processes and procedures – even more so as SARS journeys towards becoming a digitalised revenue agency.
Commissioner Kieswetter noted that the personal costs order against the Public Protector is a stark reminder to all SARS officials that each one of them represents the Government and has a profound duty to act with considerable care. SARS’ use of administrative power must always be fair, reasoned and, when necessary, firm and resolute.

As Americans empty grocery shelves over fears of possible shortages during the coronavirus pandemic, one nutritionist says healthy eating doesn’t have to fall by the wayside.
There is no need to hoard because there is plenty of food in the United States and food distributors are working to keep shelves stocked, said Diane Rigassio Radler, director of the Institute for Nutrition Interventions at Rutgers University, in New Jersey.
However, it is a good idea to have plenty of food at home to reduce the number of times you have to go grocery shopping, she added.
When you go shopping, try to go at times when stores are less crowded so that you can maintain adequate social distancing. Another option is online grocery shopping.
Wash your hands as soon as you get home from grocery shopping. Then unpack your bags. Wipe off packaged foods with an alcohol-based paper towel or commercial antimicrobial wipe, and wash all produce. If you have reusable bags, wash them if possible or wipe them down with an alcohol-based towel.
Follow the same routine if you order groceries online, she noted in a university news release.
Stock up on canned, frozen and dried non-perishable foods, but understand the differences. Canned foods last for years, but generally have a higher sodium content than the others. Frozen foods will last for months, but could go bad if there are power outages.
Dried foods, including dried beans, pasta, shelf-stable milk, and root vegetables (carrots, potatoes) and squashes (such as acorn or butternut) are also good foods to have at home, Rigassio Radler said.
A healthy diet with lots of fruits and vegetables and adequate protein and grains can help you maintain your immunity. Limit your intake of added sugar and alcohol, she advised.
Drink plenty of water, try to get 150 minutes of physical activity per week, and stay well-rested. Moderate exercise can boost immunity, and lack of sleep can weaken your immune system, Rigassio Radler said.
If you decide to go to a restaurant, maintain social distancing. Choose cooked foods rather than salad or sushi. And, most importantly, she added, always wash your hands before you eat.

Thai state of emergency begins
A state of emergency came into force in Thailand aimed at halting the spread of the virus.
Entry into the kingdom has been barred except for diplomats and returning Thais, a hammer blow for the lucrative tourism industry, while all gatherings have been outlawed.
Traffic was light in the capital Bangkok Thursday, a city usually notorious for its congestion, with virtually all shops closed and restaurants offering only takeaway.

Aussies worried about bats
Animal welfare activists in Australia appealed for calm after reports emerged that emergency services were being flooded with calls from people fearful that the country’s large populations of bats were spreading the coronavirus.
Australia is home to about 90 species of bat, including endangered “flying fox” megabats endemic to populous areas in the east.
The local branch of Humane Society International said misinformation about the flying mammals being the origin of Covid-19 posed a further threat to the animals.

Iraq extends nationwide curfew until April 11
The Iraqi government said on Thursday that it will extend a countrywide lockdown it imposed in response to the coronavirus pandemic until April 11.
Schools, universities, shopping centres and other large gathering places will remain closed, as will the country’s international airports.
Authorities have confirmed that at least 29 Iraqis have died from Covid-19 and nearly 350 others have contracted the disease.
But there are fears the real number is much higher, as only around 2 000 of Iraq’s 40 million people have been tested.

More than 250 000 declared coronavirus cases in Europe
The number of declared coronavirus cases in Europe topped 250,000, according to an AFP tally Thursday, more than half of which are in hard-hit Italy and Spain.
Europe is the worst-affected region in the world with 258 068 cases, including 14 640 deaths, ahead of Asia’s 100 937 infections and 3 636 fatalities, according to a tally compiled from national health data and World Health Organisation figures.
Italy has 74 386 registered infections and Spain has 56 188.
The global number of infections now stands at 481 230 across 182 countries, with 21 867 deaths.
The number of actual infections is believed to be higher since many countries are only testing severe cases or patients who require hospitalisation.

That is the view of Raymond van Niekerk, board member of the professional arm of WP Rugby.
“If the Lions tour generates a lot of income then it could save the game in South Africa. Everyone in the game around the world is under pressure. If you get a big financial incentive, it will offer a golden opportunity to save the industry – which takes to heart the interests of the franchise teams, players, supporters and interested parties,” Van Niekerk told Netwerk24.

The Lions last toured these shores in 2009 when the Springboks claimed a 2-1 series victory.
It remains uncertain for how long the game will be disrupted by the Covid-19 pandemic, but it is certain to have dire financial implications.
Van Niekerk said SA Rugby was hard at work, along with its stakeholders, to plot a way forward for the game.
Some European clubs have already indicated that their players would have to take pay cuts, however that is unlikely to happen in South Africa, Van Niekerk believes.
“We’re not close to cutting players’ salaries. We have a good relationship with our players. The issue is nothing that they could have controlled. There’s a big difference compared to overseas clubs who are privately owned. They move quickly and ruthlessly. We are more people-oriented because the provincial unions are involved. We want to limit the negative impact on players and personnel as much as possible.”

Well-known pastor Angus Buchan has tested positive for Covid-19 after coming into contact with infected persons at a church gathering in the Free State earlier this month.
On his Instagram page on Thursday, Buchan confirmed that he tested positive for the virus, but said he was not showing symptoms and was in good health.
“As per the regulations surrounding the virus, anyone that has been in contact with us needs to isolate themselves and, if they start displaying symptoms, they will need to get tested for the coronavirus,” Buchan added.

“We apologise for the confusion and will pray for the good health of all those who have been in contact with us.”
Buchan was part of the congregation that took part in the Jerusalem Prayer Breakfast, which was hosted by the Divine Restoration Ministries in Bloemfontein.
News24 previously reported that five international travellers at the church gathering tested positive for the virus and were in isolation at the Breakfast and Bed they were staying.
The five are tourists – two from Texas in the United States, two from Israel and one from France – and they arrived in South Africa between 9 and 11 March to attend the church gathering, which had over 200 people.

On Tuesday, the Free State health department said it had tested 360 people who may have come into contact with the five tourists.
